This experienced evoked my discovery of needing video documented wills and a unified probate system.
I had the privilege of knowing my father-in-law for 25 years, during which time I assisted him with numerous financial matters, including serving as his notary when he refinanced his home in 2004. He recounted to me the circumstances surrounding the acquisition of this residence, which he initially purchased with his former spouse, my husband’s mother. Following their divorce, he made a solemn promise to retain ownership of the home, assuring his children that it would be theirs upon his passing.
As part of the refinancing process, the lender required him to provide a letter detailing his intentions for the funds he withdrew. He articulated that he planned to undertake renovations on the house, allocate $80,000 towards purchasing a property in Mexico, and ensure that the remaining equity would be preserved for his children. At that time, the equity available for his children’s inheritance was modest; they would be fortunate to receive even $20,000 each. I advised him that, given the likelihood of his living for an additional 15 to 20 years, the value of the home would likely appreciate significantly during that period.
When he executed the loan documents, he took title to the property as his sole and separate asset. Throughout our conversations, his commitment to his first wife was a recurring theme, and he frequently expressed his intention to honor his promise to her. His current wife, for her part, openly acknowledged her indifference toward the house, indicating her plans to either return to Mexico or relocate to Houston, Texas. She was aware of her own financial resources and appeared disinterested in the property, which may explain her reluctance to permit any improvements.
Tragically, upon his passing, his wife swiftly changed the locks on the house, erected a fence, and installed surveillance cameras. She removed his will from his safe, along with all cash and valuables, and subsequently retained legal counsel to initiate the probate process, with the intention of selling the home. This deeply troubling situation was compounded by her deceit; she misled him during his final moments in the hospital.
In stark contrast, my husband has expressed little concern regarding the house. After numerous discussions, he has consistently concluded that his father loved his wife and harbors no animosity towards her. What has left me in a profound state of disbelief is the realization that she not only deceived him, but also disposed of his will and absconded with his cash, all while poised to receive one-third of the net proceeds from the sale of the home. This egregious behavior constitutes fraud. It underscores the critical importance of video wills being admissible in court, as they provide a vital safeguard against such manipulative actions.
